Terms & Conditions — Booked & Busy™ by The Ecomm Champs

Program Provider: The Ecomm Champs, LLC (“Company,” “We,” “Us,” or “Our”)

By enrolling in the Booked & Busy™ program (“Program”), you (“Client”) agree to the following terms and conditions:

1. Program Overview

The Booked & Busy™ program is a subscription-based service designed to:

• Recover missed appointments

• Reactivate old customers

• Automate follow-ups & lead capture using AI Sales Tools

• Improve booking volume through SMS, Email, and Web integrations

All plans—Silver, Gold, Diamond—include access to SaaS features, automations, and reporting as outlined on the program’s sales page.

2. Subscription Terms & Payment

• Monthly Plans: Payment is due at the start of each billing cycle.

• No Refunds: Payments are non-refundable. All fees serve to maintain active services, SaaS licenses, and integrations provided under the Program.

• Upgrades/Downgrades: Clients may request plan changes with at least 7 days’ notice before the next billing cycle.

3. ROI Guarantee (60-Day)

• We guarantee that within 60 days of onboarding, your business will recover or rebook appointments equal to or greater than your monthly subscription fee.

• If this ROI benchmark is not achieved, The Ecomm Champs will continue to work on your account at no additional cost until the goal is met.

• This guarantee does not include refunds, as all ongoing SaaS tools, automation setup, and optimization deliver continued value beyond initial results.

4. Client Responsibilities

To ensure results, the Client agrees to:

• Provide accurate business details, customer contact info, and access to scheduling systems.

• Maintain open communication for campaign approvals, reporting, and feedback.

• Ensure internal staff responds to qualified leads generated by the Program.

5. Service Scope

The Program includes:

• Automation Setup & Integrations (SMS, Email, Calendar, CRM)

• Missed Call Text-Back & Reactivation Campaigns

• Performance Reporting & Analytics

• AI Sales & Booking Tools

Any customizations, advanced landing pages, or third-party ad campaigns may incur additional fees unless included in the plan.

6. Cancellation Policy

• Clients may cancel at any time with 14 days’ written notice before the next billing cycle.

• No partial refunds are provided for mid-cycle cancellations.

7. Limitation of Liability

The Ecomm Champs is not liable for:

• Losses due to client negligence (e.g., failure to follow up on leads)

• Third-party system downtime (e.g., SMS carriers, scheduling apps)

• Unrealistic revenue expectations beyond guaranteed metrics

8. Intellectual Property

All software, automations, and workflows remain the sole property of The Ecomm Champs. Clients receive a license to use the tools during the subscription period only.

9. Governing Law

This Agreement shall be governed by the laws of [Insert State], United States.

10. Agreement

By enrolling in the Booked & Busy™ Program, the Client acknowledges they have read, understood, and agreed to these terms.
